Child guards regulations
According to the New York City Department of Health and Mental Hygiene, window guards for children are required by law.
- They should be installed on each and every window, except those situated next to fire escapes.
- The window guard must be fastened firmly on both sides of the window with special screws authorized by the Health Department. Window gates vary in size, and are adapted to fit your windows.
- If you live in a building that has at least three apartments and a child younger than 11 years of age lives with you, you must have window guards installed.
- The law applies even if you live on the first floor, as a child can also attempt to leave the house through low windows.
- Whether you are renting or living in a co-op or condominium, window guards are a mandatory feature, as per the regulations which apply to your specific place of residence.
- Only owners of one and two-family houses are exempt from installing window guards, even if there are young children on the premises.
To further protect your child, you can install additional safety devices: child safety locks make sure that your windows remain locked or that they do not open beyond four inches. Window stops are also a useful safety tool which ensures that your windows do not exceed the recommended four inches when opening.
